Starting a Contract of Service

If a new recruit who has signed the letter of employment fails to turn up for work

If a new recruit has signed the letter of employment but subsequently informed the employer that he does not intend to start work with the company and failed to turn up on his first day of work, the Employment Act does not apply as the employer-employee relationship has not started.

Hence the employer will not be able to claim notice pay or any compensation under the Employment Act.

If the employer wishes to claim compensation from the recruit, he should pursue a civil claim through his own lawyer.

Confirmation of employees

There is no provision in the Employment Act on the conditions for the confirmation of an employee in his job. An employee's confirmation will depend on the terms spelt out in the employment contract. The length of an employee's service is calculated from the date on which the employee starts work and not the date of confirmation.

Dey, the Employment Act doesn't cover white collar professionals and civil servants.

It's basically for labourers.

Read carefully here (note the word "except" and the definition of "managers and executives"):

I hope someone can provide some advice here.

I'm an (MX12 - farmer) currently looking at an opportunity to move from a stat board, working on policy, to a ministry to work on research. Pass w/ Merit only and I was very surprised to be given a chance to take a shot at a ministry post that wanted a 2:1. I suppose my experience has significant relevance to the opportunity.

Some close friends have questioned whether it would be a smart idea; from policy to research. Now I cant help but wonder the same.

My motivation to try out in the first place was exposure and getting a fresh angle in my area of expertise. I found the agency's scope and interest in the matter to be very narrow at the moment and would like to work at a more macro perspective. But is research a career advancing field or a dead end?

I was a fresh grad less than two years ago.
