Nope. it is as per your contract. Most employment contract here have a "general" contractual term that states that it will refer to the "company" policy and is applicable hence company policy get pulled into the "contract".

If you have a special negotiated (usually management level) contract, it is as per contract. If not, you can take a civil suit and sue the company on the basis on the contractual level.

As such, this present a legal loop hole that companies must plug.

So some big organisations also employ other workarounds to avoid the admin work of getting each employment contract re-sign with the employee by imposing a policy that states that this term will applicable to all employees in the contract if you are working in the company by a future date. Contractually and legally, whether that can really work may be for the courts to decide and in US , such policy can be fought over tooth and nail. But SG... harder..much harder to fight as most singaporean dont know their rights and maybe it is also because such cases involves more out of the pocket money as singapore lawyers will charge (and you are already jobless) and unless you are very rich, then can take on company.

It used to be that as long as the bonus was paid to us, we could resign. Now, the terms were changed such that we cannot resign within the bonus month or the bonus paid will be recovered from us.

Every company mentions the bonus payout for the employee in the agreement. Whether it may be 15% or the monthly or the salary based bonus. Its the matter to have the complete information on the agreement you are signing. Also an employee must know its laws too, to have better work within the company or business. Bonus also depends on the employee's work. So its better to know an employee's droit and the agreements.

In such cases where a company is constantly changing the policies of the staff handbook, are employees supposed to follow the regulations stated in the staff handbook or their own contract signed between the employee and the employer? If employees were told to follow the regulations stated in the staff handbook, what's the point of signing a contract in the first place if it's just going to be overwritten by the staff handbook. Kindly advise.
