3) Finally, Clarence felt that Judge Lee had displayed reasonable apprehension of bias against us on many hearings both in Court and in Chambers, and suggested that we apply for a judicial recusal of Judge Lee in order to ensure a fair hearing for the case.

Unfortunately, because all these instances of alleged bias took place without my presence, I was unable to see any of it with my own eyes to aid my judgement. I’m well aware that judicial recusal applications are extremely rare in Singapore, with no reported successful applications, and hence I was of course tentative in my decision.

However, given the reasonable apprehension of biasness Clarence felt he faced, and the significant amount of written evidence he provided to me to support this, compounded with the fact that I had no first hand account of these allegedly biased behaviour, I decided to allow the application to be made. It was the only way to know for sure.

Moving forward, Clarence will discharge himself from my case, and Eugene Thuraisingam and Jing Yen Chooi of Eugene Thuraisingam LLP will be taking over as legal counsel. I felt this was the best option moving forward given that Clarence had obvious difficulties working with Judge Lee, and hopefully this will streamline legal processes moving forward.


Sounds like some professional disagreement on the case strategy? Anyway clients are entitled to change their lawyers. No big deal
