Unregistered Seems you need to resign on the fourth month if you want to honor the contract.

ttan775 Here is the wording from the letter of commitment (not contract):

Should you fail to start with our client or resign within 3 months of your employment, you will be liable to compensate BGC Group an equivalent of 1 month of your offered monthly basic salary.

Resignation Notice- If you can't resign within 3 months, can you resign in the 3rd mo

This is a follow up to a previous question I asked on here about breaking the letter of commitment with the recruitment agency.

So basically I cannot resign from company A within 3 months or I will have to compensate BGC 1 month's salary.

So just to check that means that I have to work with company A for 3 months.

So if I resign in the 3rd month, and give company A one month's notice in the 3rd month, I should be safe from BGC correct, as even though I give notice in the 3rd month I am still working for that 3rd month with company A which is all that I have to work with company A.

my contract starts June 19, so I would have completed 3 months of service by Sept 19. But I was thinking since I am having such a difficulty with this job I am going to tahan for the month of Aug, I will be reaching 2 months in 1 weeks time and then after I receive my Aug pay by the 5th of September, I will give my one month's notice on the 6th of September and my last day will be the 5th of October. So some of my notice period will be in the required 3 months that I have to work with company A and a few days extra.

So just to ask any of you who had no choice but to tahan because of recruitment agency 3 months compensation clause, had you resign in the 3rd month, so is that sufficient to meet the recruitment agency clause of working with their client for 3 months.

To summarize if you cannot resign within 3 months, can you resign on the 3rd month, give the one month notice, will that still be considered working for the full 3months? Thanks for the help and input.
