Sorry that my question, about whether joining the AGC’s Legislation Division will stagnate my career, was too vague. I guess what I am worried about more broadly is marketability, in the event I find out that public service for the rest of my life is not for me. Perhaps I should scope my question as follows:

1) TC requirements - I hear serving in the AGC for 3 years to satisfy the TC requirements has now been reduced to 1 year; wondering however if joining the Legis Division will prejudice me in fulfilling this requirement as I will not get trial experience unlike for e.g. those that join Crime as DPPs.

2) Niche-ness: In the event that I do decide to move to private practice, would I be marketable? I ask this because drafting legislation seems to be pretty niche in comparison to DPP/Counsel work. I understand moving to liti after say, 2-3 years, may be difficult given my lack of trial experience, but what about corp?

The 1 year TC should be consistent across the board for lawyers in the public sector regardless of where you are posted. My guess is that you will be rotated to crime/civil to meet the relevant SILE criteria. But you should confirm this with HR.

Legis is definitely not as marketable as crime if you want to do disputes in private practice. If you are moving to private practice once you get called, firms may be willing to retrain you, but in your 2-3 year timeframe, relevant exp will be important.

Dont think there's much carryover into corp for a legis drafter. You also need to be mindful that there are other candidates out there vying for the same role who have more relevant exp so unless you are a FCH it is difficult to stand out

I disagree with other advice that it may “stagnate” your career, relative to disputes. Litigation experience, honestly, is not that hard to pick up if you have good public speaking skills.

On the other hand, if you spend your foundational years learning about legislative drafting, you may have the opportunity to advise a range of ministries and stat boards across a range of legal subjects. Depending on how skilfully you subsequently market yourself, you can highlight your experience in advisory work involving the interpreting policy and amendments behind current Singapore legislation. This can bring you into private practice or in house. The advantage of getting the legis experience when you are younger is so when you eventually go out into practice, you are cheaper. This is compared to spending time in criminal litigation departments where initially it may appear glittery in that you will have no shortage of opportunities to be first chair fairly early, but most exit opportunities are limited to disputes work.

Will leave you to scope around on LinkedIn or other publicly available information sources for success stories as there is at least one former draftsman who has reinvented their way into the private sector and is now partner level in a well known firm. There are also people who continue to languish in the public sector as they know they have nowhere else to go for the same comfortable pay. It’s really about how you are able to market yourself after joining private practice around senior associate level, what cases you are given to quickly develop your skills and what BD you do to self-promote yourself.
